Terms and Conditions for an Online Artist Apparel Store
These terms and conditions ("Terms") govern your use of our online artist apparel store ("Store"). By using the Store, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Store.

1. Definitions

"Artist" means an individual or entity that creates and sells artwork or apparel.
"Customer" means you, the user of the Store.
"Product" means any artwork or apparel that is sold through the Store.
"Store" means our online artist apparel store.
"We" or "us" means the owner and operator of the Store.
2. User Account

You may create a user account on the Store to save your shipping and billing information, track your orders, and view your purchase history. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Products and Pricing

All Products are subject to availability. We reserve the right to discontinue or limit quantities of any Product at any time, without notice. All prices for Products are displayed in Euros and are subject to change without notice. We will use our best efforts to ensure that the prices displayed on the Store are accurate, but we cannot guarantee that they will be error-free. If a Product is listed at an incorrect price, we may, at our sole discretion, either cancel your order for the Product or contact you for instructions on how to proceed with your order at the correct price.

4. Orders and Payment

To place an order, you must first add the Products you wish to purchase to your shopping cart. You will then be prompted to create a user account or sign in to your existing account. You will then be able to enter your shipping and billing information and select a payment method. We accept major credit cards and PayPal. Once you have completed the checkout process, you will receive a confirmation email with your order details.

5. Shipping and Delivery

We will ship your order to the shipping address you provided at checkout. Shipping rates and delivery times will vary depending on your location. You will be able to track your order status online or through our customer service department.

6. Returns and Exchanges

You may return or exchange a Product within 30 days of the date of purchase. To return or exchange a Product, you must first contact our customer service department to obtain a return authorization number. Once you have received a return authorization number, you may return the Product to us in its original condition and packaging. You will be responsible for the cost of shipping the returned Product.

7. Intellectual Property

All Products, including all artwork, designs, and trademarks, are the property of their respective Artists or us. You may not use any Product without the express written consent of the Artist or us.

8. Disclaimer of Warranties

THE STORE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE STORE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU ASSUME ALL RISK FOR USING THE STORE AND THE PRODUCTS.

9. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE STORE OR THE PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Store or the Products.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of laws principles.

12. Entire Agreement

These Terms constitute the entire agreement between you and us with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and effect.

14. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by both you and us.

Our shipping costs depend on the chosen payment method. Shipping costs abroad may vary. We will contact you if you have an order from outside of the Netherlands.
